In this article there is a criticism of the thesis that defines the Spanish political transition as a successful attempt to put an end to the "law of the pendulum" that had been governing our constitutional history. On the one hand, this thesis underestimates the conditions of the Spanish situation of 1978, marked by the transit between two worlds, the modern one that inherited and the emerging postmodern, which would become an unquestionable reality from 1989. In addition, the Spanish Constitution (...) of 1978 was drafted at a time when the political-normative conceptual assumptions of the dominant constitutional paradigm in Europe after World War II were declining. Likewise, the thesis ignores the specific spanish differential feature: the civil war of 1936-1939 and the subsequent rupture and radical separation of Spanish modernity into two distinct historical sections: one initiated with the French Revolution and culminated in the most absolute destruction of the pre-existing political and social order; and another that starts in 1939, since the construction of zero of a radically new pattern of society and culture, with which the Spaniards encountered in December 1975 when they assumed their full political protagonism in a situation unprecedented and completely devoid of precedents in our national constitutional tradition. The purpose of this paper is to outline a thesis which in some ways attemts to retrieve the value of meaning as a constituent element of theories. It will be argued that theories possess in common a more or less explicit relational structure, but, at the same time, they possess a meaningful function by means of which they are instruments of knowledge or, rather, by means of which theories have the value ofknowledge in science. In conclusion, it will be suggested (...) that this approach to theories allows those with weak relational structure (social, historical theories, etc.) to be treated with a degree of adequacy by the philosophy of science. Likewise, it will be suggested that the method of semantic analysis linked to the theory of “possible worlds” could be fruitful for this purpose. (shrink)

La cultura del agua debe ser vinculada de forma especial a las manifestaciones del patrimonio cultural intangible de los pueblos, como las tradiciones orales o escritas, la simbología o los rituales, que conforman lo que llamamos los Imaginarios del Agua. Estos deben ser analizados y deconstruidos a la luz de los nuevos paradigmas, como la hermenéutica y la ecocrítica. De este modo, la mitografía ayuda a perfilar el significado profundo de la cultura del agua ante las nuevas demandas medioambientales, educativas (...) y culturales del siglo XXI, en un contexto donde el agua ya no es solo un recurso estratégico, sino un bien cultural ligado al desarrollo local y a las políticas de sostenibilidad. Por ello, al conocer las tradiciones ancestrales y los imaginarios en torno al agua, y al sensibilizar a los alumnos con los valores plurales de estas manifestaciones culturales --que siempre van encaminados al respeto y al conocimiento del patrimonio natural y cultural--, contribuimos de forma decisiva a la gobernanza del agua y a la gestión sostenible y responsable de los recursos hídricos, pues sin duda el principal problema de la sostenibilidad será la educación de los ciudadanos. Water culture must be linked in a special way to expressions of intangible cultural heritage of peoples, such as oral or written traditions, symbols or rituals that make up what we call the imaginary water. They must be analyzed and deconstructed in the light of the new paradigms, such as hermeneutics and the ecocriticism. Thus, mythography helps shape the profound meaning of the culture of the water at the new environmental, educational and cultural demands of the 21st century, in a context where the water is not only a strategic resource but a cultural property linked to local development and sustainability policies. Therefore, to know the ancestral traditions and imaginaries in connection to water, and to educate students with the plural values of these cultural manifestations, --which always aimed to respect and knowledge of the natural and cultural heritage-- we contribute decisively to the governance of the water and the sustainable and responsible management of water resources then no doubt the main problem of sustainability will be the education of citizens. Este artículo analiza las aportaciones que Eloy Rada hizo a los estudios leibnicianos a través de sus ediciones de textos de Leibniz y al analizar la confrontación entre Leibniz y los newtonianos: polémica sobre el origen del Cálculo y el Análisis Matemático a finales del siglo XVII y contraposición entre las teorías del espacio y el tiempo de Newton y Leibniz. Rada mostró que el sistema newtoniano tenía una fundamentación teológico-religiosa, que fue puesta en cuestión por el (...) sistema leibniciano de la armonía preestablecida, haciendo irreconciliables las posturas de ambos. Las divergencias, incluida la discusión sobre la fuerza de la gravedad, son consecuencia de esa contraposición metafísica y teológica, que afectaba a las raíces de la religión anglicana, tal y como se había conformado a partir del latitudinarismo de los filósofos de Cambridge, de Boyle y del propio Newton y su sistema de la gravitación universal. Leibniz escribió en 1675 un texto titulado Drole de pensée, touchant une nouvelle sorte de representation. Poco conocido, este escrito se centra en proponer la creación de una academia de las representaciones, en la cual todo científico interesado podría presentar sus nuevas invenciones al público interesado en las artes y las ciencias. Del mismo modo, Leibniz propone la creación de una academia de juegos mediante la cual se financiaría tanto la academia de las representaciones como la Académie des Sciencesde París. (...) En este trabajo ofrecemos una traducción inédita del Drole de penséey destacamos la importancia del papel de Leibniz en su faceta de promotor de la comunicación científica y filosófica, faceta que también ha destacado el profesor Eloy Rada. García Morente analiza tres esculturas: Le penseur de Rodin, Il pensieroso de Miguel Ángel y la escultura de El doncel de Sigüenza que se encuentra en la catedral de esta ciudad. Esta última, afirma Morente, refleja mejor que ninguna otra la naturaleza de la filosofía. En este ensayo se rechaza esta opinión de Morente y se proponen otras dos representaciones de la actividad filosófica, en este caso pinturas, que simbolizan (...) más adecuadamente el acto de filosofar, entendido como un diálogo socrático inacabable. The agency objection to applying distributive justice globally is that principles of distributive justice need to apply to the behaviour of a special kind of institutional agent of distributive justice because of the special powers of that agent. No such agent exists capable of configuring cooperative arrangements between all persons globally, and so distributive justice does not apply globally. One response to institutional views of this kind is that they do not rule out Natural Duties of Justice that fall on (...) all of us to bring about institutional agencies capable of global distributive justice. In this article I argue that this move presupposes a particular, teleological, conception of justice whilst institutional accounts most plausibly rest on a non-teleological one. I provide an argument for favouring the non-teleological conception. I also show why alternative ways of arguing for global Natural Duties of Justice do not get around this controversy. The debate is at the level of presuppositions about justice, and relying on a partisan conception is question begging. (shrink)

There is an increasing demand by society that university students demonstrate competitive skills to enable them to achieve greater success when entering the workplace. Creativity and life satisfaction correlate positively with academic performance, productivity, and excellence in the working environment. The presence of creativity and emotional intelligence in the curriculum and teaching methods in Spanish universities, however, is surprisingly lacking. Studies that examine gender differences in these variables provide conflicting results. The purpose of our research is to analyse the changes (...) produced in both creativity and life satisfaction in university students by a positive emotional and creative intervention and explore individual differences by gender. The methodology used was a quasi-experimental pre- test/post- test design with experimental/control groups. Three hundred university students from the Community of Madrid completed three exercises that evaluated creativity and life satisfaction. The results show significantly higher results in creativity and life satisfaction in women, who continued to achieve high results after the intervention. Finally, we discuss the need for emotional and creative education in universities and focus on the employability and the guarantee of equal opportunities through the development of these competencies. This paper argues that Susan James' definition of rights as 'enforceable claims' suffers from key faults based in its descriptive approach to a normative and evaluative concept (rights). James cannot explain key and valuable functions of the concept of rights as action-guiding and reason-giving, and some upshots of the view are inconsistent with the reasons one would appeal to rights as a distinctive concept. On her view it is difficult to explain how a right can be violated, given that violation (...) appears to imply lack of effective enforcement. (shrink)

BackgroundRespect for confidentiality is important to safeguard the well-being of patients and ensure the confidence of society in the doctor-patient relationship. The aim of our study is to examine real situations in which there has been a breach of confidentiality, by means of direct observation in clinical practice.MethodsBy means of direct observation, our study examines real situations in which there has been a breach of confidentiality in a tertiary hospital. To observe and collect data on these situations, we recruited students (...) enrolled in the Medical Degree Program at the University of Cordoba. The observers recorded their entries on standardized templates during clinical internships in different departments: Internal Medicine; Gynecology and Obstetrics; Pediatrics; Emergency Medicine; General and Digestive Surgery; Maxillofacial Surgery; Plastic Surgery; Orthopedics and Traumatology; Digestive; Dermatology; Rheumatology; Mental Health; Nephrology; Pneumology; Neurology; and Ophthalmology.ResultsFollowing 7138 days and 33157 h of observation, we found an estimated Frequency Index of one breach per 62.5 h. As regards the typology of the observed breaches, the most frequent were related to the consultation and/or disclosure of clinical and/or personal data to medical personnel not involved in the patient’s clinical care, as well as people external to the hospital. As regards their severity, severe breaches were the most frequent, accounting for 46.7 % of all incidents. Most of the reported incidents were observed in public areas, such as corridors, elevators, the cafeteria, stairs, and locker rooms.ConclusionsIn addition to aspects related to hospital organization or infrastructure, we have shown that all healthcare personnel are involved in confidentiality breaches, especially physicians. While most are committed unintentionally, a non-negligible number are severe, repeated breaches, thus suggesting a certain carelessness, perhaps through ignorance about certain behaviors that can jeopardize patient confidentiality. Empiricist philosophers like Carnap invoked analyticity in order to explain a priori knowledge and necessary truth. Analyticity was “truth purely in virtue of meaning”. The view had a deflationary motivation: in Carnap’s proposal, linguistic conventions alone determine the truth of analytic sentences, and thus there is no mystery in our knowing their truth a priori, or in their necessary truth; for they are, as it were, truths of our own making. Let us call this “Carnapian conventionalism”, conventionalismC and cognates for (...) short. This conventionalistC explication of the a priori has been the target of sound criticisms. Arguments like Quine’s in “Truth by Convention” are in our view decisive: the truth of conventionalismC requires that the class of logical truths and logical validities be reductively accounted for as conventionally established; however, no such reduction is forthcoming, because logic is needed to generate the entire class from any given set of conventions properly so-called. Granted that conventionalismC is untenable, we want to take issue with a different, usually made criticism. Although the argument uncovers some difficulties for the way conventionalist claims are defended by some of its advocates, we will try to show that it fails. The criticism thus stands in the way of a proper appreciation of why the Carnapian account of the a priori is not correct. We will try to illustrate this by showing that the criticism we will dispute would dispose of conventionalist claims not only regarding philosophically problematic cases – logical and mathematical truths –, but also regarding cases for which they have some prima facie plausibility. One such case is that of truths that follow from mere abbreviations, “nominal” definitions; ‘someone is a bachelor if and only if he is an unmarried adult male’ can serve at this point for illustration. We will try to articulate a clear sense in which the contents of assertion such as this can be truths by convention. We do not need to prove that a conventionalist claim is true in those cases; it is enough for us to show that it is intelligible, for the arguments we will confront question even this. (shrink)

De re or singular thoughts are, intuitively, those essentially or constitutively about a particular object or objects; any thought about different objects would be a different thought. How should a philosophical articulation or thematization of their nature look like? In spite of extended discussion of the issue since it was brought to the attention of the philosophical community in the late fifties by Quine (1956), we are far from having a plausible response. Discussing the matter in connection with the status (...) of the Kripkean category of the contingent a priori, Donnellan (1979) argued that what can be properly classified as knowable a priori about utterances like those involving ‘one meter’ or ‘Neptune’ famously proposed by Kripke (1980) cannot be the very same singular content that is contingent he distinguished to that end between knowing a true proposition expressed by an utterance, and knowing that an utterance expresses a true proposition. Evans (1979) replied that, for a very specific sort of cases involving “descriptive names”, a related proto-two-dimensionalist account should be preferred, on which it is not the singular contingent content, but rather a general descriptive one which is knowable a priori. In a series of papers, Robin Jeshion (2000, 2001) has recently attacked Donnellan's proposal, arguing in favour of the most straightforward interpretation of Kripke's claim: in the relevant cases, the very same singular content can be both contingent and knowable a priori. This paper appeals to a generalized version of two-dimensional semantics to advance an account of the Kripkean cases along the lines of Evans's, and argues that Jeshion's compelling arguments against Donnellan's view do not apply to this version. The American Society for Bioethics and Humanities promulgated standards for clinical ethics consultants and is currently developing a national Quality Attestation in Clinical Ethics Consultation to assist facilities in ensuring that those performing clinical ethics consultations meet minimum standards. As the field moves towards such professionalization, there is a need to provide access to qualified clinical ethicists at a broad range of medical facilities. Currently, however, there are insufficient numbers of trained clinical ethicists to staff all healthcare facilities, and many (...) facilities lack the necessary resources to hire staff clinical ethicists. In this review, we describe several models for providing expert clinical ethics support to remote facilities that lack access to qualified clinical ethicists. Based on this analysis, we recommend telemedicine as the optimal model providing expert support to local ethics committee members tasked with providing clinical ethics consultation services. En esta parte del proceso investigativo se presentan los avances de la tesis doctoral de la autora que pretende aportar desde la unión entre la praxis y la academia en el campo de la administración, a los diagnósticos de los mercados de trabajo, su seguimiento y análisis de tendencias ya que, resultan fundamentales para el desarrollo de los sistemas de competencias laborales. Así mismo, se aborda la cuestión de entender las relaciones que éste problema presenta en un determinado momento en el tiempo al comparar las auto-evaluaciones entre recién egresados con las auto-evaluaciones de personas que se encuentran en una posición de alto nivel en el sector automotriz de Guanajuato y por consiguiente; establecer la brecha que tienen dichos egresados del área económico administrativa, e identificar que competencias deben desarrollar para llegar a una posición con un alto nivel de responsabilidad con un alto grado de certidumbre para lo cual, se utiliza un instrumento ampliamente probado y se presentan los resultados y hallazgos encontrados hasta el momento.
